We offer this website, including all information, tools, and services available here, conditioned on your acceptance of all terms, conditions, and policies stated below.

By visiting our site and/or renting or purchasing from us, you engage in our "Service" and agree to be bound by these Terms of Service. These Terms apply to all users of the site, including browsers, customers, and anyone who completes a rental transaction.

Please read these Terms carefully before using our website. If you don't agree to these Terms, you may not access the site or use any of our services. We reserve the right to update these Terms at any time by posting changes to this page. It's your responsibility to check back periodically. Continued use of the site after changes are posted means you accept those changes.

Section 1 – Eligibility and Account Terms

By agreeing to these Terms, you confirm that you are at least the age of majority in your province or territory of residence. You may not use this site to violate any applicable laws. You must not transmit viruses, malware, or any code of a destructive nature. Violation of any of these Terms will result in immediate termination of your access to our Services.

Renters may be required to provide valid government-issued photo ID at the time of pickup. We reserve the right to refuse a rental to anyone who cannot verify their identity or who we believe, in our sole judgment, is unable to use bear spray safely and responsibly.

Section 2 – General Conditions

We reserve the right to refuse service to anyone, for any reason, at any time.

You agree not to reproduce, duplicate, copy, sell, or exploit any part of the Service without our express written permission. The headings in this agreement are for convenience only and don't limit or affect the Terms.

Section 3 – Accuracy of Information

We're not responsible if information on this site is incomplete, inaccurate, or out of date. The content here is provided for general information purposes and shouldn't be used as the sole basis for decisions about wildlife safety or bear encounter preparedness. Always consult current guidance from Parks Canada, provincial wildlife authorities, or other authoritative sources.

We reserve the right to modify the content of this site at any time without obligation to update older material. Any reliance on this site's content is at your own risk.

Section 4 – Rental Products and Services

4a. Rental Equipment

RentBearSpray.ca rents bear spray canisters and related safety accessories for use in bear country. Rental products are subject to availability and may be limited by location, season, or quantity.

All rental equipment is inspected before each rental period. You agree to receive the equipment in good working condition and to return it in the same condition, subject to normal use. You are responsible for any damage, loss, or theft of rented equipment during your rental period.

4b. Equipment Condition and Damage

You agree to inspect the rental equipment at pickup and report any pre-existing issues immediately. If you fail to report a concern at pickup, you accept the equipment as received. Any damage caused during your rental period is your financial responsibility. We'll assess damage costs at return and charge the payment method on file.

4c. Return Obligations

Rental equipment must be returned by the date and time agreed upon at booking. Late returns may result in additional rental charges. Failure to return equipment may be treated as theft and reported to the appropriate authorities.

4d. Discharge of Bear Spray

Bear spray that has been discharged, even partially, during a bear encounter cannot be returned as a standard rental return. You agree to notify us immediately if the canister was used. A replacement fee will apply. We understand that bear encounters are emergencies, and we'll always handle these situations with that in mind.

4e. Pricing

Rental prices are subject to change without notice. All prices are in Canadian dollars unless otherwise stated. We reserve the right to modify, discontinue, or limit any rental product or service at any time.

Section 5 – Bear Spray Safety Disclaimer and Limitation of Liability

Bear spray is a wildlife deterrent, not a guarantee of safety. Its effectiveness depends on proper use, correct deployment, wind conditions, distance, and animal behaviour. RentBearSpray.ca does not warrant that use of bear spray will prevent injury or death in a bear encounter.

By renting from us, you acknowledge:

  • You have read and understood the instructions provided with the canister
  • You accept full responsibility for learning how to use bear spray correctly before entering bear country
  • RentBearSpray.ca is not liable for any injury, death, loss, or damage arising from a bear encounter, whether bear spray was used or not
  • Bear spray is a supplement to, not a replacement for, proper wildlife awareness, safe travel practices, and current guidance from Parks Canada and provincial wildlife authorities

You are required to read, sign, and comply with our separate Rental Waiver and Release of Liability before taking possession of any rental equipment. The Waiver forms part of your rental agreement and is incorporated into these Terms by reference.

Section 6 – Billing and Account Information

We reserve the right to refuse or cancel any order or rental booking. We may limit quantities per person or per household. If we cancel or modify a booking, we'll try to notify you using the contact information you provided.

You agree to provide accurate, current billing and account information. You're responsible for keeping your contact details and payment information up to date.

Section 7 – Third-Party Tools

We may give you access to third-party tools we don't control or monitor. These tools are provided "as is" without any warranties or endorsement from us. Use of any third-party tools is entirely at your own risk. We're not liable for any issues arising from your use of those tools.

Section 8 – Third-Party Links

Some content or links on this site may direct you to third-party websites. We don't control those sites and aren't responsible for their content, accuracy, or practices. Any transactions you make with third parties are between you and them. Review their terms and policies before engaging.

Section 9 – User Submissions and Comments

Any ideas, feedback, or other content you send to us may be used by us freely, without compensation or obligation to you. You're responsible for ensuring your submissions don't violate any third-party rights or applicable laws. We may remove any content we determine, at our discretion, to be unlawful, offensive, or otherwise objectionable.

Section 10 – Personal Information

Your personal information is handled in accordance with our Privacy Policy.

Section 11 – Errors and Omissions

Our site may occasionally contain typographical errors, pricing mistakes, or outdated information. We reserve the right to correct errors and update or cancel orders affected by inaccurate information, at any time and without prior notice.

To the fullest extent permitted by law, 3AM Group Inc. operating as RentBearSpray.ca, including its owners, officers, employees, agents, contractors, and service providers, will not be liable for any injury, loss, claim, or damages of any kind, including lost profits, lost revenue, or any direct, indirect, incidental, punitive, or consequential damages, arising from your use of our Service or rental products.

This includes, without limitation, any injury or loss resulting from a bear encounter, whether bear spray was deployed or not. Where provincial law limits the exclusion of certain liabilities, our liability is limited to the maximum extent permitted.

Section 14 – Indemnification

You agree to indemnify and hold harmless 3AM Group Inc. operating as RentBearSpray.ca, along with its officers, directors, employees, agents, and contractors, from any claim, demand, or expense, including reasonable legal fees, arising from your breach of these Terms, your use of rental equipment, or your violation of any law or third-party right.

Section 15 – Severability

If any part of these Terms is found to be unenforceable, that part will be enforced to the maximum extent permitted by law. The rest of the Terms remain in full force.

Section 16 – Termination

These Terms remain in effect until terminated by you or us. You may terminate by stopping use of the site and notifying us. We may terminate your access at any time, without notice, if we believe you've violated any of these Terms. Obligations incurred before termination survive the end of this agreement.

Section 17 – Entire Agreement

These Terms, along with any policies, operating rules, and the Rental Waiver and Release of Liability, make up the entire agreement between you and us regarding use of the Service. They replace any prior agreements or communications. Any failure on our part to enforce a right under these Terms isn't a waiver of that right.

Section 18 – Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein. Any disputes will be resolved in accordance with the laws applicable in Canmore, Alberta.

Section 19 – Changes to These Terms

We may update these Terms at any time by posting the revised version to this page. It's your responsibility to check this page periodically. Continued use of the site after changes are posted means you accept the updated Terms.
